The Real Estate Purchase Transaction Procedure:
Once the desired property has been selected, the purchase process can be completed either in person or remotely.
For remote purchase, a notarized power of attorney is prepared for a lawyer, which ensures the exchange of documentation electronically via email and courier services, regardless of your location.
To begin the process, a reservation agreement is prepared, which stipulates the main terms of the transaction: sale price, payment schedule, etc. When signing the reservation agreement, a deposit is required. The deposit is usually 2-5% of the total transaction amount.
It is important to note that all financial transactions are conducted in Thai baht (THB).
After the deposit is made, the seller's law firm will provide a draft purchase and sale contract for approval. This process can be done via email. In addition, you will be offered a draft land lease assignment agreement.
After the full transaction amount has been deposited into the escrow account, a date for registration with the Land Department is set. After registration, you will receive a Channote Title Deed, which confirms your ownership of the land, and a Blue Book, which is the official registration document of the building.

After signing the Purchase and Sale Agreement, funds can be transferred to the specified escrow account managed by our legal representative. Transactions are possible both in parts and at one time. The Certificate of Origin of Funds (COT) is an integral part of the package of documents for re-registration at the Land Department. This document is issued only upon confirmation of the transfer via SWIFT from the receiving bank.
Additional costs include government taxes and fees paid to the Land Department. These are usually divided equally between the buyer and the seller.
Please note that the cost of legal representatives is paid separately by each party to the transaction. Therefore, it is advisable for both the buyer and seller to have their own legal counsel to fully protect their interests throughout the process.
